Any Person that violates any of the provisions of the LMSA Regulations shall be deemed to be responsible for a municipal civil infraction which shall be punishable by a civil fine of not less than $100 nor more than $500 for the first offense and not less than $200 nor more than $1,000 for subsequent offenses, in the discretion of the Court and, in addition, to all other costs, damages and expenses provided by law.
LMSA may recover from Users its direct expenses, losses or damages, including reasonable attorney’s fees, incurred by LMSA by reason of a User’s violation of the Regulations and LMSA’s subsequent enforcement efforts resulting in voluntary compliance by the User. Such expenses shall be invoiced to the responsible User with a demand that they be paid within thirty (30) days. The User shall be given a reasonable opportunity to meet with LMSA staff to discuss or dispute the expenses or amounts to be charged, with the final determination to be made by the LMSA Board. In the event the responsible User does not pay the amounts determined by the Board to be due, the unpaid portion shall be a lien against the premises served, added to the next regular service billing and, if not paid within six (6) months, reported to the Townships as a delinquent sewer fee under section 11.L. of these Regulations and Act 94 of the Public Acts of 1933. Remedies are Cumulative. The remedies provided by these Regulations shall be deemed to be cumulative and not mutually exclusive with any other remedies available to the LMSA.
